TERMS AND CONDITIONS OF SERVICES – TOBY EXPEDITIONS

1. GENERAL INFORMATION
These Terms and Conditions regulate the use of the tourism services offered by Toby Expeditions, a tourism agency located in Cusco, Peru.
By requesting information, making a reservation, making a payment, or contracting any of our tourism services, the client declares that they have read, understood, and accepted these Terms and Conditions.

2. PURPOSE OF THE SERVICE
Toby Expeditions offers tourism services within Peru, especially in the Cusco region and other national destinations, including tours, excursions, tour packages, trekking activities, tourist transportation, guiding services, ticket coordination, reservations, and other services related to tourism activities.
The specific details of each service, such as itinerary, duration, price, inclusions, exclusions, schedules, meeting point, required physical conditions, and particular policies, will be provided to the client before confirming the reservation.
3. RESERVATIONS
To make a reservation, the client must provide complete and truthful information, including full names, identity document or passport number, nationality, date of birth, contact details, and any other information necessary for the proper provision of the service.
The reservation will be considered confirmed only when Toby Expeditions has received the corresponding payment, either total or partial, according to the conditions indicated at the time of quotation.
The client is responsible for verifying that the information provided is correct. Toby Expeditions is not responsible for errors resulting from incomplete, incorrect, or late information provided by the client.
4. PRICES AND PAYMENTS
The prices of tourism services will be informed to the client before confirming the reservation. Prices may be expressed in Peruvian soles or U.S. dollars, depending on the service offered.
- Payments may be made through the methods authorized by Toby Expeditions.
- Some services may require an advance payment or full payment to guarantee the reservation.
- Bank fees, payment platform commissions, international transfer charges, or other similar expenses will be assumed by the client, unless otherwise indicated.
- Prices may vary depending on season, availability, supplier rate changes, entrance tickets, train tickets, transportation, permits, or other third-party services.
Once the service has been confirmed, any change requested by the client may generate additional costs.
5. INCLUDED AND NOT INCLUDED SERVICES
The services included and not included will be detailed in the description of each tour, package, or quotation sent to the client.
In general, a service may include a tour guide, transportation, entrance tickets, assistance, accommodation, meals, or other elements, provided that they are expressly indicated in the service proposal.
No service shall be considered included unless it has been expressly mentioned in the quotation, booking confirmation, or tour description.
6. CHANGES TO THE RESERVATION
Changes requested by the client are subject to availability, the conditions of the contracted service, and the policies of external providers, such as hotels, operators, transportation companies, train companies, airlines, ticket administrators, and other tourism service providers.
When a change involves additional costs, these must be assumed by the client before the modified service is provided.
For services subject to limited availability, such as entrance tickets to tourist attractions, train tickets, special permits, or fixed-date services, changes may not be allowed or may be subject to penalties.
7. CANCELLATIONS AND REFUNDS
Cancellations must be requested in writing by email to info@tobyexpeditions.com or through the official customer service channels of Toby Expeditions.
Cancellation and refund conditions may vary depending on the type of tour, package, season, availability, and the policies of external providers.
- Payments made for entrance tickets, train tickets, flights, permits, accommodation, third-party services, or non-refundable reservations may not be refundable.
- Cancellations made with short notice may generate partial or total penalties.
- The client’s failure to appear on the indicated date, time, or place will be considered a no show and will not entitle the client to a refund.
- Approved refunds will be made after deducting administrative expenses, bank commissions, payment platform charges, and costs already assumed by Toby Expeditions.
When a service has a special cancellation policy, it will be informed to the client before confirming the reservation and will prevail over the general conditions indicated here.
8. CANCELLATION OR MODIFICATION BY TOBY EXPEDITIONS
Toby Expeditions may modify, reschedule, or cancel a service for justified reasons, such as weather conditions, client safety, road blockages, strikes, authority regulations, closure of tourist attractions, emergencies, force majeure, unforeseeable events, or any circumstance that prevents the normal provision of the service.
In such cases, Toby Expeditions will try to offer the client an alternative, rescheduling, or reasonable solution, according to availability and the conditions of the providers involved.
Toby Expeditions will not be responsible for additional expenses assumed by the client as a result of changes beyond our control, such as additional nights, missed flights, missed connections, meals, additional transportation, or other personal expenses.
9. CLIENT RESPONSIBILITIES
The client agrees to:
- Provide truthful, complete, and updated information.
- Arrive on time at the indicated place and time.
- Carry an identity document, passport, tickets, permits, or documents required for the service.
- Inform in advance about medical conditions, allergies, dietary restrictions, or special needs relevant to the trip.
- Follow the instructions of the guide, authorized staff, or service providers.
- Respect safety rules, cultural heritage conservation rules, the environment, and coexistence with local communities.
- Avoid actions that may put their own safety, the safety of other passengers, or the proper execution of the service at risk.
Toby Expeditions reserves the right to deny or suspend the participation of a client when their conduct represents a risk to themselves, other travelers, staff, third parties, or the normal development of the tour.
10. TRAVEL DOCUMENTATION
The client is responsible for having valid and current documents to carry out the trip or contracted activity, including identity document, passport, permits, visas, authorizations for minors, insurance, or other documents that may be required.
Toby Expeditions will not be responsible for the client’s inability to take a service due to missing, expired, incorrect, or invalid personal documents.
11. HEALTH, PHYSICAL CONDITION, AND SAFETY
Some tourism services may take place in high-altitude areas, natural trails, rural zones, or places that require moderate or high physical effort. The client declares that they are in suitable condition to participate in the contracted activity.
The client must inform Toby Expeditions before booking about any medical condition, treatment, allergy, physical limitation, pregnancy, dietary restriction, or special situation that may affect their participation in the service.
Toby Expeditions may recommend not participating in certain activities when it considers that there is a risk to the client’s health or safety.
12. THIRD-PARTY SERVICES
For the provision of some services, Toby Expeditions may coordinate with external providers, such as hotels, restaurants, transportation companies, tour operators, guides, railway companies, airlines, administrators of tourist attractions, or other service providers.
When the service depends on third parties, the client accepts that certain conditions, changes, restrictions, penalties, or cancellation policies will be subject to the rules established by those providers.
Toby Expeditions will act with diligence in coordinating the contracted services, but will not be responsible for events attributable exclusively to external providers or for circumstances beyond its reasonable control.
13. LUGGAGE AND PERSONAL BELONGINGS
The client is responsible for the care of their luggage, documents, money, electronic devices, cameras, mobile phones, valuables, and personal belongings throughout the service.
Toby Expeditions is not responsible for loss, theft, damage, or forgotten personal items, unless direct responsibility of the company is proven.
14. TRAVEL INSURANCE
The client is advised to purchase travel insurance covering medical assistance, accidents, cancellations, luggage loss, delays, emergencies, and other risks related to tourism activities.
Unless expressly indicated in the service description, travel insurance is not included in the prices offered by Toby Expeditions.
15. USE OF IMAGES AND TESTIMONIALS
During tours, Toby Expeditions may take photographs or videos for promotional, informational, or experience-recording purposes. When applicable, authorization will be requested from the client for the use of their image on social media, website, advertising material, or other official channels.
The client may request that their image not be used by writing to info@tobyexpeditions.com.
16. INTELLECTUAL PROPERTY
The content published on the Toby Expeditions website, including texts, images, logos, designs, itineraries, photographs, videos, and informational material, is the property of Toby Expeditions or is used with authorization.
The reproduction, copying, distribution, modification, or commercial use of such content without prior written authorization from Toby Expeditions is prohibited.
17. PERSONAL DATA PROTECTION
The personal data provided by the client will be processed in accordance with our Personal Data Processing Policy and applicable Peruvian regulations.
The client authorizes Toby Expeditions to use their data to manage reservations, coordinate tourism services, process payments, issue receipts, provide assistance, and comply with legal or contractual obligations related to the contracted service.

The client may also request information about the physical or virtual Complaints Book, when applicable, in accordance with Peruvian consumer protection regulations.
19. LIMITATION OF LIABILITY
Toby Expeditions will not be responsible for breaches, delays, losses, damages, additional expenses, or modifications caused by circumstances beyond its reasonable control, including, among others, weather conditions, natural disasters, protests, road blockages, accidents, closure of routes or tourist attractions, authority decisions, health emergencies, third-party failures, or force majeure situations.
The liability of Toby Expeditions, when applicable, will be limited to the value of the service contracted directly with the company, excluding indirect expenses, missed connections, flights, additional accommodation, loss of profit, or other costs not contracted with Toby Expeditions.
20. CHANGES TO THE TERMS AND CONDITIONS
Toby Expeditions reserves the right to update, modify, or replace these Terms and Conditions at any time in order to adapt them to legal, operational, commercial, or service-related changes.
The current version will be published on our website and will apply to reservations made after its publication.
21. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of the Republic of Peru, including applicable regulations on civil, commercial, tourism, consumer protection, and personal data protection matters.
In the event of any dispute, the parties will seek to resolve it directly and amicably. If this is not possible, they may resort to the competent authorities in accordance with current Peruvian legislation.
